Acceptance

These Terms of Service (the “Terms”) govern your use of marschcapital.com and the software applications and integrations operated by MARSCH Capital, LLC (“MARSCH Capital,” “we,” “us”) (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services

The website is informational. Our applications perform the specific functions described when you install or connect them, including, where you authorize it, functions that read from or write to your accounts with third-party services such as Google. You may disconnect an application at any time through the third-party service’s security settings.

No offer, solicitation, or advice

Nothing on the Services constitutes an offer to sell or a solicitation of an offer to buy any security or other investment, nor investment, legal, accounting, or tax advice. The Services describe a private firm that invests its own capital. Nothing here should be relied upon in making any investment decision.

Acceptable use

You agree not to misuse the Services. Among other things, you will not attempt to probe, disable, or disrupt them; access them by automated means that impose unreasonable load; use them to violate applicable law or the rights of others; or reverse engineer them except where that restriction is prohibited by law.

Your content and accounts

Where an application processes data from accounts you connect, you represent that you have the right to grant that access. You retain all rights to your data; we claim no ownership of it, and our handling of it is described in our Privacy Policy.

Intellectual property

The Services, including their text, design, and marks, are the property of MARSCH Capital or its licensors. No license is granted except as needed to use the Services as offered.

Third-party services

The Services may link to or interoperate with services we do not control, including Google. Your use of those services is governed by their own terms and policies, and we are not responsible for them.

Disclaimer of warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, MARSCH Capital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to the Services, and our aggregate liability for any claim will not exceed one hundred United States dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You will indemnify and hold MARSCH Capital harmless from claims arising out of your misuse of the Services or violation of these Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to conflict-of-laws rules. The courts located in San Juan, Puerto Rico will have exclusive jurisdiction over any dispute arising from the Services.

Changes

We may revise these Terms by posting the revised version on this page with a new effective date. Continued use of the Services after a change takes effect constitutes acceptance.
